‘P’

The person to whom any COP application relates.

Attorney

The person(s) appointed by the Donor to take care of their affairs and make decisions on their behalf.

Certificate Provider

The person who certifies that the Donor has capacity, understands the documents and is not under any duress.

COP

The Court of Protection. This is the Court that will deal with any disputes over Lasting Powers of Attorney or determines how an Attorney can/must act.

Donor

The person making the Lasting Powers of Attorney and to whom the powers relate.

H&W

Health and Welfare Lasting Powers of Attorney.

Instructions

Legally binding instructions the Attorneys must follow or they cannot act.

Jointly

All decisions must be made together with your other named Attorneys. If your other named Attorneys are unable to unwilling to act, a decision cannot be made.

Jointly & Severally

Attorneys can make decisions together or individually. This is the most flexible way Attorneys can act.

LA

The Local Authority for the relevant area.

Life Sustaining Treatment (‘LST’)

Any form of medical treatment that will not cure you, but will prolong your life.

LPA(s)

Lasting Powers of Attorney(s).

Mental Capacity

The required cognitive ability to make your own decisions.

OPG

The Office of the Public Guardian. This is the government organisation that handles the registration of Lasting Powers of Attorneys.

P&F

Property and Finance Lasting Powers of Attorney.

People to Notify

Those named in the LPA to be notified of the application to register the Lasting Powers of Attorney as a safeguarding tool.

Preferences

Non-legally bonding directions to the Attorneys about the Donor’s preferred wishes.

Replacement Attorney

The person(s) appointed by the Donor to take care of their affairs and make decisions on their behalf only in the event the first named Attorneys are unable or unwilling to act.
